These Terms and Conditions (“Terms”) govern your use of the Driving Edge mobile application and related services (the “App”, “Platform”, or “Service”).
By creating an account as a Student or Instructor, you agree to be legally bound by these Terms. If you do not agree, you must not use Driving Edge.
1. About Driving Edge
Driving Edge is a UK-based technology platform that enables driving instructors and students to manage lessons, scheduling, payments, expenses, messaging, and learning progress.
Driving Edge does not provide driving instruction, employ instructors, or act as a driving school.
2. Eligibility
To use Driving Edge, you must:
- Be at least 17 years old
- Be legally capable of entering into a contract
- Provide accurate, current, and complete information
Instructors
Instructors must:
- Be legally authorised to provide driving instruction in the UK
- Hold valid qualifications, insurance, and vehicle compliance as required by law
We reserve the right to suspend or terminate accounts that do not meet eligibility requirements.
3. Account Registration & Security
- You are responsible for maintaining the confidentiality of your login details
- You must not share your account with others
- You are responsible for all activity carried out through your account
- Driving Edge is not responsible for unauthorised access caused by your failure to secure your account.
4. Instructor-Specific Terms
By registering as an Instructor, you acknowledge and agree that:
- You are an independent contractor, not an employee, agent, or partner of Driving Edge
- You are solely responsible for:
- Lesson delivery and quality
- Student safety during lessons
- Compliance with DVSA regulations and UK law
- Vehicle roadworthiness and insurance
- You set your own prices, availability, and cancellation policies
- You are responsible for declaring and paying any applicable taxes
- Driving Edge does not supervise, assess, or guarantee instructor performance.
5. Student-Specific Terms
By registering as a Student, you agree that:
- Driving instruction is provided by independent instructors, not Driving Edge
- You are responsible for attending lessons on time
- You must follow instructor safety guidance
- Payment, cancellation, and refund terms are set by your chosen instructor
- Driving Edge does not guarantee driving test outcomes or lesson results.
6. Payments, Credits and Fees
6.1 Payments
Driving Edge supports multiple payment methods depending on instructor settings:
- Card payments are processed in-app via third-party payment providers such as Stripe.
- Bank transfers are arranged directly between students and instructors and do not occur within the Driving Edge app.
Driving Edge:
- Does not process, verify, or track bank transfer payments
- Is not responsible for missing, delayed, or disputed bank transfers
- Does not act as a payment agent or escrow service for bank transfers
Instructors are solely responsible for confirming receipt of any bank transfer payments.
6.2 Credits
- Credits are a digital balance used within Driving Edge
- Credits have no cash value and cannot be withdrawn
- Credits are:
- Instructor-specific
- Non-transferable
- Non-refundable within the app
Driving Edge reserves the right to amend credit rules, provided this does not affect existing statutory rights.
6.3 Platform Fees
- Driving Edge may charge platform or transaction fees
- Any applicable fees will be clearly displayed before payment
6.4 Payment Disputes
- Payment disputes relating to bank transfers must be resolved directly between the student and instructor
- Disputes relating to card payments must follow the payment provider’s dispute process
- Driving Edge may assist with communication but does not guarantee resolution
7. Cancellation & Refunds
- Cancellation and refund policies are determined by individual instructors
- Driving Edge is not liable for missed lessons, cancellations, or refund disputes
- We may assist with dispute communication but do not guarantee resolution
8. Messaging, Notifications & Read Status
- Messages sent through Driving Edge may be stored, delivered, and marked as read
- Messaging is provided to support lesson communication and scheduling
- You must not send abusive, offensive, unlawful, or inappropriate content
Driving Edge reserves the right to moderate, restrict, or remove content where required.
9. Learning Progress & Assessments
9.1 Progress Tracking & Skill Ratings
- Progress tracking and skill ratings are informational tools only
- They do not constitute professional certification or test readiness guarantees
- Instructors are responsible for the accuracy of ratings they submit
9.2 Instructor Assessments & Passed Status
Any indication within Driving Edge that a student has “passed”, “is ready”, or similar wording is based solely on information provided by the instructor.
Such status:
- Does not represent an official driving test result
- Does not constitute certification or legal authorisation to drive independently
- Does not replace or override requirements set by the DVSA or UK law
10. Prohibited Use
You must not:
- Use the App for unlawful or fraudulent purposes
- Harass, threaten, or abuse other users
- Attempt to access or manipulate data you are not authorised to access
- Reverse engineer, copy, or misuse the App or its systems
11. Suspension and Termination
Driving Edge may suspend or terminate accounts if:
- These Terms are breached
- The App is misused
- Required by law or regulatory authorities
You may close your account at any time via the App.
12. Limitation of Liability
To the maximum extent permitted by UK law:
Driving Edge is not liable for:
- Accidents, injuries, or damages during lessons
- Driving test outcomes
- Instructor conduct or availability
- Disputes between students and instructors
Use of the App is at your own risk.
Nothing in these Terms limits liability for death or personal injury caused by negligence where prohibited by law.
13. Indemnity
You agree to indemnify and hold harmless Driving Edge from any claims, losses, or liabilities arising from:
- Your use of the App
- Your breach of these Terms
- Your interactions with other users
14. Data Protection
Personal data is processed in accordance with our Privacy Policy, in compliance with UK GDPR and the Data Protection Act 2018.
15. Changes to These Terms
Driving Edge may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts.
